Notice for California Residents and Additional U.S. State Privacy Disclosures

Do Not Sell or Share My Personal Information

This Notice for California residents and certain other U.S. State residents (this “State Privacy Notice”) supplements the information contained in the True Fit Privacy Policy and applies to individuals who reside in California and in other U.S. states that have enacted comprehensive privacy laws requiring enhanced disclosures, including Connecticut, Colorado, Virginia, Utah, Texas, Oregon, Montana, Indiana, Kentucky, and Rhode Island (collectively, “Consumers,” “you,” or “your”).


This State Privacy Notice is provided to comply with the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), and analogous state privacy laws, including the CTDPA, CPA, VCDPA, UCPA, TDPSA, OCPA, MCDPA, ICDPA, KCDPA, and RIDTPPA. Terms defined in these laws have the same meaning when used in this Notice.

We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household (“Personal Information”).

We may process limited Sensitive Personal Information (as defined by the CPRA and similar laws), such as measurements or characteristics relevant to apparel fit.


We do not use or disclose Sensitive Personal Information for purposes that require offering a right to limit its use under the CPRA.

In addition to the purposes listed above, we collect and use Personal Information to:

  • Process requests and transactions
  • Provide customer support and respond to inquiries
  • Create, maintain, customize, and secure accounts
  • Conduct research, testing, analytics, and product development
  • Maintain safety, security, and integrity of our systems
  • Detect and prevent fraud and security incidents
  • Comply with legal obligations
  • Facilitate corporate transactions (e.g., merger or acquisition)

We disclose Personal Information for business purposes to:

  • Service providers and processors
  • Analytics and measurement partners
  • Retail and business partners, where necessary to provide the Services or at your direction

In the past 12 months, we have disclosed the following categories for business purposes:

  • Identifiers
  • Customer Records Information
  • Protected Classification Characteristics
  • Internet / Network Activity
  • Inferences

We do not sell Personal Information in exchange for monetary consideration.

However, we may “share” Personal Information for purposes of cross-context behavioral advertising, as defined under the CPRA and similar state laws. You have the right to opt out of the sale or sharing of Personal Information, including for targeted advertising.

Depending on your state of residence, you may have the right to:

  • Correct inaccurate Personal Information
  • Delete Personal Information, subject to legal exceptions
  • Obtain a portable copy of your Personal Information
  • Opt out of the sale or sharing of Personal Information
  • Opt out of targeted advertising
  • Opt out of certain profiling activities
  • Appeal our decision regarding a rights request (where required by law)

We will not discriminate against you for exercising your privacy rights.

Authorized agents may submit requests on your behalf where permitted by law. We will verify your identity consistent with applicable legal requirements and respond within statutory timeframes.

We recognize Global Privacy Control (GPC) signals as a valid request to opt out of the sale or sharing of Personal Information and targeted advertising, where required by law.

We retain Personal Information only for as long as reasonably necessary to fulfill the purposes described in this Notice, unless a longer retention period is required or permitted by law.

We will not deny goods or services, charge different prices, or provide a different level or quality of services because you exercised your privacy rights, except as permitted by law.
We may offer lawful financial incentives, which will be described in separate terms and subject to opt-in consent.

California’s “Shine the Light” law (Civil Code §1798.83) permits California residents to request information regarding disclosures of Personal Information to third parties for direct marketing purposes. Requests may be submitted using the contact information below.

We may update this State Privacy Notice from time to time. When we do, we will revise the “Last Updated” date above. Continued use of our Services after changes are posted constitutes acceptance where permitted by law.
